The contract between the two parties (customer and Obvious Parfums) is concluded upon receipt of the e-mail indicating that the products have been dispatched. To place an order on our website, you must follow the steps below. Our order process allows you to review the information and make any corrections before confirming your order.

For every order, we include samples, including samples of the fragrance(s) purchased, so that you can try them before opening the product for sale and return it to us if it does not suit you.

You can track your parcel at any time via the carrier's website indicated in your shipping confirmation e-mail by entering your parcel number. DELIVERY DELAY OR FAILURE
Any delivery defect or delay of more than 7 days must be reported to our customer service team as soon as possible.
DEFECTIVE PRODUCT
We have a legal obligation to provide products that conform to the order we have accepted. If your purchase is defective or arrives damaged, we advise you to inform us as soon as possible in order to exercise your legal consumer rights. Please send us an e-mail at contact@obviousparfums.com enclosing photographs of your defective product. If, following an examination of the returned product, we agree with you, we will offer either to replace the product free of charge or to refund you, including the postage costs you paid to return it to us.
CANCELLATION AND RIGHT OF WITHDRAWAL
The Customer may request the cancellation of their order as long as it has not yet been dispatched. If the order has not yet been shipped, the Seller will proceed with its cancellation and refund as promptly as possible. Once the order has been dispatched, the Customer may no longer request its cancellation but may, if applicable, exercise their right of withdrawal.
In accordance with Article L.221-18 of the French Consumer Code, the customer has the right to change their mind within 14 days from the date of receipt of the order, without having to provide a reason, in accordance with the terms set out below.

RETURNS AND REFUNDS
Orders subject to the right of withdrawal must be returned within 14 days from the date of delivery. The returned product(s) must be intact, unopened, unused, and in their original packaging. Any item not meeting these conditions will not be eligible for a refund. Furthermore, no product purchased on the website may be returned to a retailer, and vice versa.
Orders within France: Returns are free of charge for Metropolitan France only. Once the withdrawal request has been approved, a Colissimo return label will be sent to you by e-mail.
Orders outside France: return shipping costs are the responsibility of the customer. The return address will be communicated to you once the withdrawal request has been approved. The delivery note must be included with the returned order without fail.
Upon receipt of the returned product, its condition will be checked to ensure that it is returned complete, in perfect condition, unused, unopened, and in its original packaging. Subject to the return complying with these conditions, a refund will be issued as promptly as possible, using the same payment method as the one used at the time of the order.
In accordance with applicable legal provisions, we will refund or exchange defective products, non-conforming products, or products that do not match your order.
Products sold on our website are subject to the legal warranty conditions set out in Articles L 211-4, L 211-5, and L 211-12 of the French Consumer Code, as well as Articles 1641 and 1648 of the French Civil Code:
Article 1641 of the French Civil Code: The seller is bound by the warranty in respect of hidden defects of the item sold which render it unfit for the purpose for which it was intended, or which so diminish its use that the buyer would not have purchased it, or would only have paid a lower price for it, had they been aware of them.
Article 1648 of the French Civil Code: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect. Article L211-12 of the French Consumer Code: The action resulting from a lack of conformity is subject to a limitation period of two years from the date of delivery of the goods.
The company Différentes Latitudes cannot be held liable for any indirect damage that may arise from the purchase of products, from the consequences of use not in accordance with the intended purpose of the product, or from product defects and their consequences resulting from any external cause. The company Différentes Latitudes cannot be held liable for the non-performance or improper performance of the contract attributable to the consumer, to force majeure, or to the unforeseeable and insurmountable act of a third party to the contract.

Products sold on our website are subject to the legal warranty conditions set out in Articles L 211-4, L 211-5, and L 211-12 of the French Consumer Code, as well as Articles 1641 and 1648 of the French Civil Code:
Article 1641 of the French Civil Code: The seller is bound by the warranty in respect of hidden defects of the item sold which render it unfit for the purpose for which it was intended, or which so diminish its use that the buyer would not have purchased it, or would only have paid a lower price for it, had they been aware of them.
Article 1648 of the French Civil Code: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, on pain of foreclosure, within one year from the date on which the seller may be discharged of liability for apparent defects.
Article L211-4 of the French Consumer Code: The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the latter has been made the seller's responsibility under the contract or has been carried out under the seller's supervision.
Article L211-5 of the French Consumer Code: To be in conformity with the contract, the goods must:
- Be fit for the purpose ordinarily expected of similar goods and, where applicable, correspond to: the description given by the seller and possess the qualities presented by the seller to the buyer in the form of a sample or model; present the qualities that a buyer may legitimately expect in light of public statements made by the seller, the manufacturer, or their representative, in particular in advertising or labelling;
- Present the characteristics agreed upon by both parties, or be fit for any particular purpose sought by the buyer, brought to the seller's attention, and accepted by the seller.
Article L211-12 of the French Consumer Code: The action resulting from a lack of conformity is subject to a limitation period of two years from the date of delivery of the goods.
The company Différentes Latitudes cannot be held liable for any indirect damage that may arise from the purchase of products, from the consequences of use not in accordance with the intended purpose of the product, or from product defects and their consequences resulting from any external cause. The company Différentes Latitudes cannot be held liable for the non-performance or improper performance of the contract attributable to the consumer, to force majeure, or to the unforeseeable and insurmountable act of a third party to the contract.
The Différentes Latitudes brand, as well as all brands, photographs, illustrations, logos, designs and models, copyrights, and content appearing on the website are the exclusive property of the company Différentes Latitudes and/or the relevant intellectual property rights holder.
Any total or partial reproduction of the Différentes Latitudes brand, as well as all brands, photographs, illustrations, logos, designs and models, copyrights, and content appearing on the website, is strictly prohibited without the express, written, and prior consent of the company Différentes Latitudes and/or the relevant intellectual property rights holder, and would constitute an act of counterfeiting. Any hypertext link to this website, or any use of framing or hotlinking (in-line linking) techniques, is strictly prohibited without the express, written, and prior authorisation of the company Différentes Latitudes.
Entire agreement
The parties acknowledge that this contract constitutes the entire agreement concluded between them.
Nullity of a contractual provision
If any provision of these General Terms and Conditions of Sale is declared void, such nullity shall not entail the nullity of the other provisions of the General Terms and Conditions of Sale, which shall remain in force.
Waiver
The fact that the company Différentes Latitudes refrains from requiring the performance of any of the provisions of these General Terms and Conditions of Sale cannot be interpreted as a waiver of the right to subsequently invoke the non-performance of the provision in question.
Modification
The company Différentes Latitudes reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the website. In the event of any modification, the applicable General Terms and Conditions of Sale shall be those published online on the website at the date of order validation.
These general terms and conditions and the sales to which they relate are governed by French law. Any dispute relating to the existence, interpretation, performance, or termination of the contract concluded between the company Différentes Latitudes and the consumer, even in the event of multiple defendants, shall, in the absence of an amicable agreement, fall under the exclusive jurisdiction of the Paris courts.
